Acceptable Use Policy

Effective Date: 1 June 2023

  1. Purpose This Acceptable Use Policy (“Policy”) outlines the rules and guidelines for using the services and facilities provided by Edgeworks Data Centre* (“the Data Centre”). By accessing or using the Data Centre’s services, you agree to comply with this Policy. This Policy is designed to ensure a secure, reliable, and respectful environment for all users.
  2. Compliance with Laws and Regulations Users of the Data Centre must comply with all applicable laws, regulations, and industry standards related to their use of the services. This includes, but is not limited to, laws pertaining to data protection, intellectual property, and computer misuse.
  3. Authorized Access to the Data Centre is limited to authorized personnel only. Users must not attempt to gain unauthorized access to any systems, accounts, or data. Any attempt to access unauthorized resources is strictly prohibited and may result in legal action.
  4. Prohibited Activities The following activities are strictly prohibited and may result in immediate termination of access to the Data Centre services:
    *Applicable to all Edgeworks companies including: Edge Centres (Malaysia) Sdn. Bhd; Edge Centres Vietnam LLC; Edge Centres Thailand Co., Ltd
    1. Unauthorized Access:
      • Attempting to access or use other users’ data, accounts, or systems without proper authorization.
      • Circumventing or bypassing any security measures implemented by the Data Centre.
    2. Malicious Software and Activities:
      • Intentionally introducing malware, viruses, worms, or any malicious software that could disrupt or harm the Data Centre’s infrastructure, systems, or networks.
      • Engaging in any form of hacking, cracking, or unauthorized penetration testing.
    3. Spam and Unauthorized Advertising:
      • Distributing unsolicited or bulk emails (spam) or any form of unauthorized advertising through the Data Centre’s services.
      • Using the Data Centre’s resources for the purpose of email harvesting, list building, or any activity that violates anti-spam laws.
    4. Intellectual Property Rights:
      • Violating copyright, trademark, patent, or any other intellectual property rights of the Data Centre or any third party.
      • Unauthorized distribution, reproduction, or sharing of copyrighted materials.
    5. Prohibition of Illegal Activities:
      • Using the Data Centre’s servers or services for the hosting, distribution, or dissemination of pornography material or gambling, or any other illegal activities.
      • Engaging in activities that promote, facilitate, or enable illegal activities or content.
  5. Data Privacy and Security
    • The Data Centre takes data privacy and security seriously. We have implemented measures to protect user data. However, users must also take responsibility for securing their own data and using appropriate security measures. The Data Centre is not liable for any loss, unauthorized access, or misuse of user data.
  6. Resource Usage
    • Users are expected to use the resources of the Data Centre responsibly and efficiently. Excessive or disruptive use that may impact the experience of other users is prohibited. This includes, but is not limited to, excessive bandwidth consumption, CPU or memory usage, and network abuse.
  7. Reporting Violations
    • If you suspect any violation of this Policy, please report it immediately to [email protected]. Provide as much detail as possible regarding the incident. The Data Centre will investigate all reports promptly and take appropriate action.
  8. Consequences of Violations Violation of this Policy may result in one or more of the following consequences:
    • Suspension or termination of access to the Data Centre’s services.
    • Legal action or reporting the violation to relevant law enforcement authorities.
    • Any other action deemed necessary to enforce this Policy and protect the integrity and security of the Data Centre.
  9. Policy Updates
    • The Data Centre reserves the right to update or modify this Policy at any time. Users are responsible for regularly reviewing this Policy and complying with the latest version.
  10. Agreement and Acceptance By accessing or using the services provided by the Data Centre, you acknowledge that you have read, understood, and agreed to abide by this Acceptable Use Policy.
